INTERNATIONAL CONSULTANT JORDAN – COMMERCIAL MEDIATION
assist the Government of Jordan with building consensus on the ways to establish commercial mediation as an effective dispute resolution mechanism used nationwide;
assist the Government of Jordan with assessing and analyzing the legal framework and practice regarding commercial mediation, identifying issues and solutions, and
assist the Government of Jordan with developing a country-specific action plan to establish commercial mediation as an effective dispute resolution mechanism used nationwide.
This will contribute to the social-economic development of Jordan by promoting fairer and faster commercial dispute resolution through effectively functioning ADR.
The assignment is especially important given the fact that the use of effective mediation services is likely not only to support and complement the justice system and thrive national economy and investments, but to enhance the social peace. This is achieved because, with the help of the mediator, the parties manage to design a meaningful engagement process with outcomes that they share ownership, and therefore will very likely be voluntarily implemented, without appeals or needed enforcements. This allows the parties to improve and restore their business and social relationships with excellent implications for a sustainable business environment, for families and for children, regardless of their level of involvement. In short, the assignment is touching the heart of the Jordanian society and culture, by aiming to improve its future.
Deliverables to be provided:
A Brief guide on the use of judicial and private mediation,
An Outline on the articles to be included in the new draft Law based on the best practices,
A Functional Analysis and Recommendations Report,
A Mediation Action Plan.
